Terms of Service for TheStoryWand

Welcome to TheStoryWand! These Terms of Service ("Terms") govern your use of our website, services, and the purchase of credits to generate AI-illustrated e-books ("Service"). By using our Service, you agree to these Terms.

1. Company Information (Imprint)

2. Description of Service

TheStoryWand provides a service where users can purchase credits. Each credit can be redeemed to generate one (1) illustrated e-book in PDF format. The user provides a text plot, and our service, using generative AI ("GenAI"), creates accompanying illustrations and formats the final book.

3. User Accounts & Responsibilities

You are responsible for any activity that occurs through your account. You agree not to use the Service for any illegal or unauthorized purpose. You are solely responsible for the plot and text you submit ("User Input"). You must not submit content that is hateful, defamatory, infringing on copyright, or otherwise illegal.

4. Purchase of Credits

⚠️ IMPORTANT: ALL SALES ARE FINAL

  • Credits are purchased in advance through our online shop. All prices listed in EUR are final prices.
  • NO REFUNDS: Once purchased, credits are NON-REFUNDABLE under any circumstances
  • As a small business, we do not charge VAT, and therefore VAT is not included or itemized.
  • Payments are processed by our third-party payment provider, [Name of Payment Processor, e.g., Stripe, PayPal]. We do not store your full credit card information.
  • A purchased credit is valid for [e.g., 24 months] from the date of purchase.

  • Your Input: You retain full ownership and all intellectual property rights to the text plot you submit to the Service.
  • The Generated Book: We grant you a perpetual, worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute the final generated PDF book for both personal and commercial purposes.
  • Our Service: We retain all rights to our website, branding, and the underlying technology and software.
  • AI-Generated Images Disclaimer: The copyright status of images created by generative AI is complex and varies by jurisdiction. While we grant you a broad license to use the final book, we do not warrant the copyright eligibility of individual AI-generated images. You are responsible for ensuring your use of the generated content is compliant with your local laws.

6. NO WARRANTY - DISCLAIMER

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We explicitly DISCLAIM ALL WARRANTIES including but not limited to:

  • NO WARRANTY of merchantability
  • NO WARRANTY of fitness for a particular purpose
  • NO WARRANTY of non-infringement
  • NO WARRANTY regarding the quality, accuracy, or content of generated books
  • NO WARRANTY that the service will meet your requirements
  • NO WARRANTY that the service will be uninterrupted or error-free
  • NO WARRANTY regarding AI-generated content suitability

YOU USE THIS SERVICE ENTIRELY AT YOUR OWN RISK.

Specifically:

  • We do NOT guarantee the quality of AI-generated illustrations
  • We do NOT guarantee story coherence or appropriateness
  • We do NOT guarantee that generated content will be suitable for children
  • We do NOT guarantee availability or uptime
  • We do NOT guarantee that content will meet your expectations
  • We do NOT guarantee bug-free operation

By using our service, you acknowledge and accept all risks associated with AI-generated content.

7. REFUND POLICY

ALL SALES ARE FINAL. ABSOLUTELY NO REFUNDS.

Please refer to our separate NO REFUND POLICY document for complete details. By purchasing credits, you explicitly waive all refund rights.

8. Limitation of Liability

To the maximum extent permitted by law, [Your Business Name] shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Service. Our total liability for any claim arising out of these Terms will not exceed the amount you paid for the credits in question.
